Small dogs pretend to be cute and friendly, but they are, actually, vicious creatures that attack things in mindless frenzies. Were that dog on the prosecution's side, it would horribly maul the defendant. I had to suffer a couple of small dogs when I was younger and here are some of the things they did:

Chased a squirrel into the house, tortured it, bit off its tail, then, when it escaped into a place they could not reach, spent two days in a near-constant barking frenzy.

Leaned down and put their noses to the ground, in order to distract other dogs and, then, rapidly, viciously attacked while loudly barking and making other threatening noises. They did this with any dogs that were larger than themselves.

Chased a dog around, forcing it go back and forth, while angrily barking at it.

Any time they saw anything that appeared to be a threat, even one that was outside, they stiffened, got a mad stare in their eyes and barked and ran around with seemingly limitless energy until they were satisfied.

I would never want to get on the bad side of a small dog.

Whether the dog's an attorney or a witness, his cuteness is a plus - and it would be more obvious if smiles were more obvious on people in the frame. But because the smiles were not obvious to me at first glance, I first thought the dog was either having a seizure or rolling in something stinky, so it took me a couple of minutes to figure it out.

My first thought also was that the dog is an attorney. In comics (as well as television and the movies), glasses are understood to indicate a person is more scholarly. Presumably attorneys are scholarly because they went to law school. The cartoonist felt compelled to some how distinguish him as part of the legal team as opposed to "just some dog".

I agree with the prior explanations except I think he's not a witness - he's an attorney. That explains why he's not on the witness stand and sort of makes an observation about lawyers who rely on their own cute "tricks" or their own personal charisma to win over juries and judges.
